1. General Terms and Conditions for Switzerland and Europe (Zone 1*)
This online shop is operated by LABEL17 GmbH, CH - 8008 Zurich (hereinafter referred to as "LABEL17"). By placing an order in the online shop "LABEL17" or by telephone in Switzerland or Europe (Zone 1*), you enter into a contractual relationship. This contractual relationship is governed exclusively by the General Terms and Conditions.
These General Terms and Conditions apply to the order and delivery offer for Switzerland and Europe (zone 1*). Orders via this online shop can only be placed by persons of legal age who have a valid residential address in Switzerland or Europe (zone 1*). We ship the goods exclusively to delivery addresses within Switzerland or Europe (zone 1*).
"LABEL17" expressly reserves the right to amend these terms and conditions at any time. The version of the General Terms and Conditions (GTC) valid at the time of conclusion of the contract shall apply in each case.
*Europe Zone 1: Switzerland, Germany, France, Italy, Spain, Portugal, Netherlands, Republic of Ireland, Netherlands, Belgium, Sweden, Finland, Denmark, Greece, Liechtenstein and Austria.
2. Conclusion of contract
The order is placed online via the order page of the online shop, by e-mail or by telephone.

The presentation of the products and the size and purchase recommendations in the online shop do not constitute a legally binding application, but merely a non-binding online catalogue. If you merely place products in the shopping basket, this does not constitute a binding order. A binding order exists when you have paid for the goods by credit card (American Express/ Mastercard/ Visa) or PayPal; upon confirmation of the payment order by the respective payment service provider. We can accept the contract with you either by sending you a contract confirmation or by delivering the goods within seven days.
You can select goods from our range in our online shop and collect them in the electronic shopping cart by clicking the "Add to cart" button. An order is not triggered until you have entered all the data required for processing the contract, confirmed that you have read these GTC and triggered payment. As long as you have not yet paid for your order, you can change it at any time. The sending of the order, i.e. you have already paid for it by credit card or Paypal, is deemed to be the conclusion of the contract.
After the final delivery, you will receive an automatic confirmation from us and one from the respective payment service provider by e-mail when you pay for your order. The one from us contains an overview of all items purchased, the one from the payment service provider contains an overview of the payment made. The receipt of these confirmations constitutes a legally valid purchase contract.
3. Shipping and delivery
We will charge you the shipping costs listed in each case, depending on the total value of the order, depending on the shipping location and depending on the shipping method.
The ordered goods can only be shipped to an address in Switzerland or Europe (zone 1*).
Delivery is at the customer's own risk.
If an item is not available after receipt of your order, e.g. due to damage, you will be informed as soon as possible, but no later than 3 working days after your order. In this case, your order for the non-available item is deemed to have been rejected. For the available articles, the contract is concluded in accordance with Clause 2.2.
Within Switzerland and Europe (Zone 1*), we will send your delivery by Swiss Post/Postal Courier. You expressly agree the carrier with your order.
Our consignment will be delivered personally if possible, but without checking the identity of the recipient at your delivery address. If no person is encountered at the delivery address, it can also be placed in the letterbox if this is possible due to the size of the parcel. You are liable if your parcel is lost. Otherwise, the delivery will be deemed to have failed and will be carried out again at the next possible time and after giving reasonable notice.

4. compensation for damages
Claims for damages due to errors in illustrations, prices and texts or due to size, maintenance or sales recommendations or due to late or non-delivery are excluded (strictly rejected).
5. right of withdrawal
We grant you a right of withdrawal. Please send us your revocation in writing by letter or e-mail within 7 days after receipt of the goods. The date of dispatch of the revocation is decisive for the observance of the deadline. The exercise of the right of revocation does not require any justification. The revocation is to be sent to:

The exercise of the right of revocation leads to the conversion of the purchase contract into a reverse transaction, according to which the services received under the purchase contract are to be returned. The goods received must be returned within 7 days of the declaration of revocation at the latest.
In the event of a revocation, please return the goods to us immediately in the original packaging. The goods must be unworn and show no signs of use. The costs for the return shipment by post are to be borne by you.
6. return and exchange
A return of goods purchased in the "LABEL17" online shop is considered a revocation (see point 5 Right of revocation). You may return the ordered goods to us within 7 days after receipt of the goods without stating any reasons.
The return of the goods by post is at your expense and risk. We recommend that you keep the proof of purchase for your return. No return or exchange without proof of purchase.

You can choose between exchanging the goods for an equivalent model, or a voucher for the amount of the purchase. Other warranty claims are excluded.
7. retention of title
The goods shall remain the property of LABEL17 GmbH until payment has been made in full.

All prices are in Swiss francs, including value added tax.
"LABEL17" may change or adjust the prices at any time. The prices valid at the time of the conclusion of the contract shall be decisive for the individual order.
9 Price reduction due to promotions
If the order date falls within the period of a promotion with a price reduction, the customer is entitled to a price reduction on the items advertised in the promotion. If the order date is outside the specified period, there is no entitlement to a price reduction on ordered items in the promotion.

Payment can be made by credit card (American Express/ Mastercard/ Visa) or PayPal. If you pay by credit card or PayPal, the data transfer is encrypted. LABEL17" assumes no liability for the security of the transmitted data.
11. assignment
We reserve the right to assign or pledge our due purchase price claims against you arising from deliveries of goods, including any partial amounts due, interest on arrears and reminder fees, to third parties.
12. Warranty
In the event of defects in the goods, the statutory warranty provisions shall apply. We ask you to immediately notify us of any obvious material or manufacturing defects of our articles that are recognizable upon delivery, including transport damage. If possible and available, we will replace the defective goods by returning them to you free of charge.
Other claims of the customer - no matter for what legal reason - are excluded as far as legally permissible. "LABEL17", its vicarious agents and assistants shall not be liable for any damage not caused to the goods themselves, in particular not for consequential damages, loss of profit or other financial losses of the Customer.
13. reference to telephone costs
If you wish to contact us by telephone after visiting our online store, e.g. in connection with the delivery of the articles or their return, we would like to point out that, unless otherwise stated, telephone charges will be incurred for calls from landlines or mobile networks. The amount of the charges depends on the respective communication provider. These costs will be charged to you in any case.

All image rights are owned by LABEL17 GmbH or its partners. Use without express permission is not permitted.
17. Applicable Law; Place of Jurisdiction
The substantive law of Switzerland shall apply exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention).
Any disputes arising in connection with the Online Shop and your purchase of goods shall be settled in Switzerland, at the registered office of "LABEL17 GmbH" (8008 Zurich, Canton of Zurich). The place of jurisdiction shall be determined in accordance with Art. 22 of the Jurisdiction Act.
